Legal Defense Fund Participates on Court Hearing in Berkeley Schools’ Case

berkeley-unified-school-districtThe California Court of Appeals this week heard oral arguments over the contention that the Berkeley (Cal.) school district’s pupil assignment plan, which is intended to foster school integration, is discriminatory.

The schools’ plan, which has been supported by the NAACP Legal Defense and Educational Fund (LDF), assigns students to its elementary schools on the basis of three factors: their family’s residential location and parental educational level; their family income; and their race and/or ethnicity.

The plan has been challenged by the conservative Pacific Legal Foundation, which is representing the American Civil Rights Foundation, the organization headed by Ward Connerly.
